Agreement & Signature VENDOR AGREEMENT — 19th Annual México-Tenochtitlan Celebration Ceremony
Please read the following terms and conditions carefully before submitting your application. By applying and participating as a vendor, you agree to comply with all event policies and requirements.
1. Respect for Cultural and Sacred Space
All vendors must respect the sacred, cultural, and community-centered nature of this event. Vendors selling items, displaying materials, or engaging in activities that disrespect, mock, exploit, or misappropriate Indigenous cultures, traditions, or peoples will not be permitted to participate and may be removed from the event without refund.
2. Application Approval and Vendor Acceptance
Submission of an application does not guarantee acceptance into the event. Approved vendors will receive a separate notification and payment instructions. Vendor fees will only be collected after an application has been approved.
3. Vendor Space and Payment
Vendor spaces are limited and will be assigned in the order that approved applications and full payment are received. Food vendor spaces may be subject to additional limitations based on availability. Vendor fees are non-refundable once payment has been received. No booth sharing is permitted unless prior written approval has been granted by event organizers.
4. Vendor Setup and Breakdown
Setup will take place on Friday from 11:00 AM - 1:00 PM. Breakdown begins Sunday at 6:00 PM. All vendors must exit the parking lot by 9:00 PM on Sunday. Vendors are responsible for providing their own tents, canopies, tables, chairs, displays, signage, and all other equipment necessary to operate their booth. Vendors must adhere to all assigned setup and breakdown schedules and must vacate the event area by the designated closing time.
5. Booth Safety Requirements
All tents, canopies, and similar structures must be properly secured with adequate weights, such as sandbags or water weights. Event organizers reserve the right to require additional safety measures or prohibit unsafe structures.
6. Cleanliness and Waste Removal
Vendors must maintain a clean, safe, and organized booth area throughout the event. Vendors are responsible for providing their own trash bags and removing all trash, debris, and materials generated by their booth. Failure to properly clean the assigned vending space may result in exclusion from future events.
7. Alcohol, Drugs, and Prohibited Activities
The possession, use, distribution, or sale of illegal drugs, controlled substances, or alcoholic beverages is strictly prohibited unless specifically authorized in writing by event organizers. Any vendor or vendor representative found consuming, possessing, distributing, or selling prohibited substances will be required to leave the event immediately without refund.
8. Compliance with Laws and Regulations
All vendors must comply with all applicable City of Salinas regulations, California state laws, county health regulations, fire codes, and event rules. Vendors selling taxable goods must possess a valid California Seller's Permit and make it available upon request.
9. Insurance
Vendors are strongly encouraged to carry general liability insurance and name Calpulli Yaocuauhtli or You Are the Medicine, the City of Salinas, and any applicable event partners as additional insured parties. While not required, insurance coverage is highly recommended.
10. Rain or Shine - No Refunds
THIS IS A RAIN OR SHINE EVENT. No refunds will be issued due to weather conditions, natural events, attendance levels, or other circumstances beyond the control of event organizers.
11. Event Conduct and Vendor Removal
Calpulli Yaocuauhtli / You Are the Medicine and the City of Salinas reserve the right to restrict, remove, or deny participation to any vendor whose conduct, products, displays, materials, noise level, methods of operation, or activities are deemed inappropriate, unsafe, disruptive, offensive, or inconsistent with the character and purpose of the event. Any vendor removed for violation of event policies will not be entitled to a refund.
12. Release of Liability and Indemnification
Neither Calpulli Yaocuauhtli / You Are the Medicine, the City of Salinas, the Recreation-Park Division - Central Park, nor any of their officers, directors, employees, agents, volunteers, members, partners, contractors, or representatives shall be responsible for any injury, illness, loss, theft, damage, or expense incurred by vendors, their employees, representatives, guests, or property while traveling to or from the event or while participating in the event. Vendors participate at their own risk and assume full responsibility for their property, merchandise, equipment, and personnel.
The vendor agrees to indemnify, defend, and hold harmless Calpulli Yaocuauhtli / You Are the Medicine, the City of Salinas, the Recreation-Park Division - Central Park, and their officers, directors, employees, agents, volunteers, members, and representatives from and against any claims, liabilities, damages, losses, costs, expenses, judgments, or legal actions, including reasonable attorneys' fees, arising out of or related to the vendor's participation in the event, acts, omissions, negligence, operations, products, or activities.
13. Acknowledgment and Agreement
By signing below, I acknowledge that I have read, understood, and agree to abide by all terms, conditions, rules, regulations, and requirements contained in this Vendor Agreement and any additional materials provided by event organizers. I understand that all rules, regulations, vendor approvals, booth assignments, and event requirements are subject to the final determination of Calpulli Yaocuauhtli / You Are the Medicine.
